I believe the jury is still out on whether the name "Cliff House" can actually be trademarked. As someone pointed out, there are numerous other Cliff Houses around the country, not surprisingly most of which are buildings perched on cliffs.

Also, can a commonly used name be trademarked, especially one that's been in use for 128 years? As a simile, could someone trademark the name Ferry Building?

The previous owners do have trademarks on various logos they created for use on signs, menus, etc., but does that infer copyright of the two words "Cliff House" when used in any other way?

I'm sure some really well-paid lawyers will thrash this out.
